Question by Janet: If I never actually signed a contract with Dish Network, am I bound to keep the service?
Last fall, when we moved back to a suburb, we opted out of cable because the price was so high. Dish sounded like the best deal with phone, internet and cable. We called and had the dish installed and cables ran throughout the house. There was never a paper contract presented to us or mentioned. I believe I made the appointment for installation, payment and everything over the phone. I don’t think I ever saw or heard contract terms, much less signed a contract.
So this past Sunday [it's now Friday], I watched some TV. I then watched a recorded show off the DVR. At the end of the show, I noticed the TV was black. There was an error message. I’ve seen that message numerous times [we've had the same issue many, many times] and can usually resolve it by resetting the machine by the little red button under the front panel. I tried that twice with no luck. It just reset and went back to the error message. I got frustrated, turned everything off, left for a few hours, came back, reset box again and got the same error message. I called Dish who asked me to reset it again, then unplug it from the wall – both requests resulted in the same error message. Then I was transferred to specialized support who asked me to use the menu to go through some steps to search for satelites or something. After a very long and rude conversation where I was accused of about everything by the support staff, I was told I would have to pay for the cable guy to come to my house. I was annoyed but said fine. The first appointment was Wednesday but then was moved to Thursday and then moved to today. He’s now 90 minutes late.
In the meanwhile, I haven’t had the option of watching tv at home all week – except what I had recorded on the DVR. The customer service has been terrible. I’m so frustrated.
So, I’m wondering if there is some implied contract. If allowing installation of the dish, locked us into a year-long service agreement or anything. How can I find out if I have a contract? Does anyone have any advice for a frustrated customer?! Thanks!

There is usually an implied contract for two years.
Dish has usually very good service, but there are rude people everywhere. You can complain to the service supervisor.

2 years ago April,2004 I joined Extreme Fitness. I paid .00 a month PLUS .00 for a trainer. WEll my back and neck went out. I took a month off. Went back and told my trainer what happened. I told him my DOCTOR told me to tell him NO more machines that will involve the neck. He introduced me to different machines. I left and hurt badly. I signed a contract for 1 YEAR. I knew I was bound to this. so, I let it be taken out of my visa when I signed up.
In the year 2005,April I was NOW free of them and I could save .00 a month.This is terrible but, I did NOT check my VISA statements till NOW. and know what? They have been taking that money out for all that time. I went there today telling them I KNOW I was liable for the FIRST year, but, how come I have had to pay all this time? WEll, it seems in the contract I did sign was a clause. I SHOULD have gone in to cancel in person. It’s in MY contract. There is NOTHING I can do. What kind of business is this?Sad.
NO I did NOT even KNOW I had to go in and advise them.. to me when the year was up.. I’m done. Wrong!
I did go and talk to the manager.. too bad so sad.. told me to read my contract next time. I TOLD him it was their duty to tell their customers of this.. to me THIS is a SCAM!… And I am out a LOT of money!

I signed a contract with a datings service. Less than three days later, they said they lost the signature page and asked me to resign. I didn’t resend them anything and no service has been provided to date. However, they did hound me to send them the signature page again. Because they were so unprofessional, I decided I didn’t want to proceed and told them not to expect anything from me. 3 weeks later, the manager of the service called me and said she found the signature page and that I was obligated to use their service. BTW, when I signed the original contract she said she would send me my copy because the copy machine was broke…I know…dumb on my part. Since I have in writing that they said they didn’t have a contract….am I still bound by this contract? I did subsequently send them a certified letter after she said she “found the signature page” and said I was exercising my 72 hr. window for cancellation.

sounds like you gave them a credit card and they are going to bill you on it. Call the dating company and make sure they canceled the subscription to their service as per your request within 72 hours. If they did not, tell them to remove any charges from your credit card, or else you are going to call the credit card company and “charge back” the amount anyway. A charge back will remove the charge from your card, and there will be an additional charge to their charge account with their charge card service provider pending an investigation. They won’t want to go through all that, especially if they are jerking you around.

City Parking Ltd (“Parking Ltd”) owns a multi-storey car park. Entrance to the car park is via an automatic barrier. Alongside the barrier is a ticket machine which dispenses a ticket to each driver giving the time of arrival. Taking a ticket permits entry by causing the barrier to rise. Alongside the barrier is a large notice setting out the company’s charges and stating:
MOTORISTS SHOULD TAKE A TICKET FROM THE MACHINE AND PAY AT THE EXIT.
TAKING A TICKET BINDS THE USER TO THE COMPANY’S TERMS AND CONDITIONS WHICH ARE DISPLAYED INSIDE THE CAR PARK.
Inside the car park a notice exists on the ground floor that states:
MEMBERS OF THE PUBLIC USE THE CAR PARK ENTIRELY AT THEIR OWN RISK IN RESPECT OF THEIR PERSONS AND PROPERTY
Can anyone tell me what i can write for this? I know it is exclusion clauses, but does anyone know how i could answer it? I really do not know and need help

a dating service?? no binding contract unless you signed a conract, if they lost the signaure page..ooppps sounds like they are trying to lure you in again. demand that she send you a copy of the signature page. if you have never recieved the signature copy then its not binding. she sounds like a shady lady
